The Supreme People's Procuratorate of the People's Republic of China (PRC) and the General Political Department (GPD) of the Chinese People's Liberation Army (PLA) recently revised and promulgated the document entitled the Provisions on the Standards for Filing Criminal Cases of Violating Duty by Military Personnel for Investigation and Prosecution (hereinafter referred to as the Provisions), further expounding the 31 crimes of violating duty by military personnel stipulated in Chapter X of the Criminal Law of the People's Republic of China and clarifying the standards for filing the criminal cases for investigation and prosecution.
The newly-revised Provisions, totaling 40 articles, specifies the standards for filing the 31 crimes of violating duty by military personnel for investigation and prosecution, adjusts the starting point of filing of 39 suspected criminal items of 14 criminal cases and explicitly defines the scope of application and the terms such as "wartime", "violation of duty", "weaponry and equipment", "military supplies", "direct economic loss" and "indirect economic loss" as well as other matters, making the Provisions much more standard, authoritative and operative.
